Property Possesion Is With Maternal Uncle But Property Belongs To Us

My Maternal uncle and my father had taken a plot in the joint account, after which the land was divided according to the money and we had built a house on our land. We did not live there, so we gave it to my uncle to live. Almost 07 years have passed but now uncle is not giving up his possession and And on the contrary, he is asking for money by making false accounts. What should we do in such a situation that our house becomes vacant?

In your case, since the property was jointly purchased and later divided, but now your maternal uncle is wrongfully holding possession of your portion, the first step would be to issue a legal notice to your uncle, demanding him to vacate the house and hand over possession, as you are the rightful owner of that portion of the property. If he refuses, you can file a civil suit for possession in the local court, seeking an order to reclaim your house. You can also ask for an injunction to prevent him from making any changes or claiming ownership based on false accounts. If your uncle has created false financial claims, you can challenge those claims by providing proof of the original division of property and any relevant documents.
