Property Partition and the procedure for that

My Father's Mother had a property, which was partitioned between my dad and one of his brother. Now the property was transfered to my dad by his mother through her will (one half). However, till date no separate property papers have been made for the divided share. The other party has the original (undivided) house papers and are now refusing to give us the papers, so that we can make our own house papers. I want to know, how can we get a house paper for our share. what is the process in such cases. Can the will help to create our house papers, or do we need the originals. Thank you
