31-Mar-2025 (In Property Law)
Dear sir My dad purchased a flat in year 1967 he paid for the flat but he bought it in the name of my grandfather. My grand father expired in the year 1991 and society by passing the resolution in AGM made my father member of the flat and added his name in share certificate. and their in list my fathers name is shown as member. In the year 2016 the society had gone under redevelopment. And the agreement was made between my father as owner and the builder. Now can legal heirer claim right.

The other legal heirs of your grandfather can claim right in the property as your grandfather had expired without any will or any deed in favor of your father. Feel free to contact me for seeking any legal advice as regards the same.

If other heirs of your grandfather including your uncle and aunt if any can claim their share. In another situation as the legal heirs slept over their legal rights since from 1991i.e.32 years they are barred by provisions of limitation act to file a suit.
