Property ownership after death of owner when family paid a part of the

My younger brother purchased an under construction flat in 2014 and took some money from me ( elder brother ). Property is still under construction and in younger brothers name. Elder brother just transferred some amount around 30% of the cost. Now the younger brother has passed away and the property would be divided among his widow and our mother. Can elder brother claim some part of the property here as he made some payments to his brother which younger brother used to pay for the demand of the flat.

Dear Sir.. We need to know that whether you have paid the full amount pertaining to property or not.. Also is there are any other joint owner of the flat.. It will be better if you can contact us for the solutions..

kindly share all the details like how much the amount was transferred and whether any amount was returned before the sad demise. accordingly it can be handled. succession certificate and later partition deed if required will be processed. succession certificate will attract court fees. further if there is already a will then on the basis of will, it can be done. regards gyan prakash
