Property in my mother's name cam my son claim it?

02-Feb-2023 (In Property Law)

My mom is the owner of all properties and my son is only one year old. And my wife is living with my son in her own family not in-laws family, means separate from me. Can my wife claim on my mom's property for my son? Will my son has any right to take my mom's property in future? If my mom gives gift all properties to anyone, So my son can claim on that property in future?

Dear Sir,
Your one year old son will have right in the share of your mother property by virtue of a will/ gift deed or in case it is an ancestral property. Or from your interest or share in the property of your mother.

If the property is purchased by your mother, your son cannot claim it during her lifetime or during your lifetime. Your mother can sell it, gift it or write a will in favor of anyone even to the stranger.

No, your wife cannot claim anything from your mother for your one year old son. Its better for your mother to make a will in favor of whosoever she wants to inherit her property after her demise. If it is your ancestral property property than however certain other things would be required to be done. Besides your wife can claim maintenance from you for the upbringing of the son.
