Property dispute - my son is threating me for property
23-Jun-2025 (In Property Law)
My name is Kalaiselvi. My husband has written his whole ancestry property to my name before he died. Now, my elder son is threating me to give the share. But am not interested to give him. He nd his wife treated me very disrespectfully.
Based on the information provided, it appears that your husband bequeathed his entire ancestral property to you before his passing, as per his will. Under Indian property law, if a valid will exists and has been duly executed, the property legally belongs to you as the beneficiary. Your elder son's threats to claim the property may not hold legal ground unless he can prove a legal entitlement, such as a prior agreement or a challenge to the will's validity (e.g., fraud, coercion, or lack of testamentary capacity). However, you are not obligated to transfer the property to him simply due to his demands or disrespectful behavior. As the legal owner, you have the right to retain and manage the property as you see fit. That said, family disputes over property can escalate, and it may be prudent to seek a formal legal opinion on the will's enforceability and any potential claims your son might raise.
hello mam, I can well understand your concern from the query raised, firstly, since your husband has lawfully transferred the property to you , you are the absolute owner of the said property, and your son cannot claim it as a matter of right, if you are being repeatedly threatened by your son, you can file a police complaint, restraining him and his wife from interfering with your peaceful possesion of the property thank you
