I am a widow of defense personnel. My husband brought a land from my dowry money in the name of his mother. Now he has passed away and his mother want to divide it among all three sons.Since it is brought by money and I sacrificed a lot in initial days I don't want to share the land,Please advice. Also if its case of streedhan how can I prove that my dowry was used as in 1980s dowry wasnt a crime and i hadnt kept any evidence.
you have no right to claim that the said property was purchase by you husband in name of his mother from the money of your dowry . The section 4 of Benami transaction act 1988 provides that No suit. Claim or action to enforce any right in respect of any property held benami against the person in whose name the property is held or against any other person shall lie by or of behalf of a person claiming to be the real owner of such property. the act only provided exception if the property purchased t any person in the name of his wife or unmarried daughter
