Procedure to claim share in father's ancestral property by son.

In the ancestral property, a hindu father having 2 son A& B , the father giving the that ancestral property to one son (A) when he is alive .now the other son (B) are claiming that ancestral property which is given by his father to son (A).

A father cannot will an ancestral property only to one son. A person can only will self acquired property. You can file a partition suit for your right but burden will be on you to prove it is an ancestral property and not the self acquired one. If you are in possession of part of property you also need not to pay court fee. If value of property is more than 2 crore you have to file partition suit before high court in Delhi.
