Pet Laws In India - Can a Company ban people from owning pets?

01-Sep-2024 (In Property Law)
Can a Company disallow tenants of the Company's quarters (residents of their Colonies) from owning pets like dogs/cats while they live there? Can they frame a rule in their colony that tenants are prohibited from owning pets?

A company can establish rules regarding the use of its quarters, including restrictions on pet ownership, especially if such rules are clearly mentioned in the lease or rental agreement signed by the tenants. However, these rules must be reasonable and should not violate any existing laws related to animal welfare. The legal remedy for tenants would be to verify whether the company’s restriction is clearly stated in the agreement they signed. If the rules were introduced after moving in without prior notice or agreement, tenants can challenge the new rule by raising a formal complaint with the company or approaching a legal forum, arguing that owning pets is a personal right and that the restriction is unreasonable unless justified by safety or health concerns. If necessary, tenants may approach a consumer court or civil court to challenge the rule as arbitrary, especially if it violates broader rights under animal welfare laws, such as the Prevention of Cruelty to Animals Act, 1960, which protects pets from being unfairly banned from residential premises.
