payment to builder from blood relatives account

04-Oct-2023 (In Property Law)
I have purchased a new under construction property in Mumbai on self funding basis. property is registered on my name only. while making payment 90% payment is made by me from my account but around 10% money paid by my younger brother to directly builder wrongly instead of sending to my account bcoz of lack of knowledge in us. And all the money which was paid by brother to builder that I have returned to brother account with heavy interest and also have taken NOC. Can my brother claim share in future in said property as some money he had directly paid to builder bt property register just my name only.

This is my response to you:
1. It does not matter;
2. You are the whole and sole owner of the flat;
3. Since the flat is in your name you become the sole owner;
4. Yes, your brother could stake a claim (though without merit);
5. But you have obtained NOC so it is positive for you;
6. Just make sure you keep bank statements as proof that you have paid for the flat;
7. If you face any difficulty then consult a local lawyer.
