Payed amount as advance towards buying property now seller ignoring

sir, i gave one person a sum of money over the period of 10 months this year as advance to purchasing his house , the transfer was made through internet banking to his bank account direct , what i want to ask is he has backed down now can i use the legal route by showing the pass book entry and internet bank segments in court to recover the money , that is only proof i have got
