A partition suit has been filed by 8 plaintiffs through a Counsel by signing Vakkalatnama .The suit is pending before the Court Now the said Counsel declined to represent the plaintiff. Therefore t he plaintiffs have to appoint another counsel to proceed the suit In this regard what will be the consequences if out of the 8 plaintiffs only 5 plaintiffs sign a vakkalatnama authorizing another Counsel , as the other three are not willing to sail with the others

If the case has already been filed and pending before the court, the advocate for the plaintiffs should report no instructions or his unwillingness to continue with the case in writing before the court, after that the plaintiffs can appoint a new advocate. In this if some of the plaintiffs do not want to engage any advocate, they can appear as party in person and can join the other plaintiffs to sail along with them.
