Partition suit final decree passed .property sold status of sold prope

In a partition suit the court without informing properly called all the coparcener and started bidding for two residential property and allotted properties to the highest bidding coparcener. In the circumstances is the process deemed as sale and if so is it attracts stamp duty and registration. Can this order be appealed by any aggrieved coparcener.

Sir, any order can be appealed against. Similarly an order passed against in final decree proceedings can also be appealed against. Bidding and sale would take place only if it has been ordered that the property is indivisible or the mode of division accepted is sale.
