Partition and Title Suit for Ancestral Land Dispute in Muzaffarpur
11-Jan-2025 (In Property Law)
One of my lands was divided into three parts during the Cadastral Survey. However, in the 1962 Revisional Survey, there was an error. While one of my family members correctly registered their name, my portion of the land was recorded under the second party's name in the survey records. Despite this, I have been in possession of the land to date. However, in November 2024, the second party sold the land I have been possessing.
Since your portion of the land was mistakenly recorded under the second party’s name in the 1962 Revisional Survey, but you have been in continuous possession, you may claim ownership through adverse possession if you’ve held the land for 12 years or more. You should first send a legal notice to the buyer and seller, asserting your possession rights. Simultaneously, you can approach the Revenue Department or Land Records Office to correct the survey records, providing proof of possession. If the sale proceeds, file a civil suit for declaration of ownership or possession. Consulting a property lawyer will help navigate the legal process and secure your claim.
