Parents not accepting marriage,will that effect my share in property

My family : Father + Mother + Elder Brother (Married + 2 Children) + Me -Younger (Married +1 Child) + Sister (Married + 2 Children) @ District-Navsari 396360, Gujarat. I married to my choice, love marrige 12 years ago & having 1 son. But from my marriage to till date my family members do not allow us to Introduce with any social gatherings. They only allow me to do but they are ignoring my wife & son. we are living in Virar-Mumbai from our marriage period. we are visiting our village town often. Here my question is my father occupied two houses in village town. Now, how can I claim my rights on one of them property ? shall I claim or not ? My Elder brother & his wife creates strong hold over my parents, just because of them my parents listening to them. Please advise In these circumstances what should i do to get my rights ? Is it possible for me to get something or not ? Whatever your comments are upon the same, highly appreciable. Thanks & Regards

If the said property is self acquired by your father with his own earned money then, your father reserves the right to transfer the property to whomever he wishes to. However, if the said property is ancestral in nature then, you have the right to claim your share in the property, for which you will have to file a partition suit in the civil court. Also, even in the case of self acquired property if your father dies without making any will, then also, you can claim the share in the property.
