22-Oct-2023 (In Property Law)
I reside in a pagdi system room since birth, currently i am residing the with my family,
and few years back my father's brother's fist son came with his family in the name of medicine to be done from Mumbai,
and few months back i cam to know from he owner the he has registered a case with false documents stating he resides here
and he wants bill to be transferred on his name, so can you guide me what is the legal way handle this matter.
and the Landlord is asking a huge amount to get the bill transfer on my name can this be done without there NOC.
This is my response to you:
1. The cousin of your can demand the same since he was living there;
2. But he cannot transfer the original tenancy from your father;
3. To transfer the same, your NOC will be needed;
4. So consult a local lawyer with your full facts and then take steps forward.

What are the rights of tenants in Pagdi?
Ans. The Pagdi System is a pre independence rental law which gives the tenant ownership rights of the rented property. This includes the right to sublet or sell the property while giving a portion to the owner. 30-Mar-2023
What to do if landlord refuses to give deposit back?
Talking to an attorney is the next step if talking to your landlord doesnt help. He will assist you in drafting a Legal Notice that you can send to your landlord. If that doesnt help, you can file a civil lawsuit in court to recover the rental deposit. 27-May-2022
What happens if there is no rental agreement?
Tenant issues:
You can be asked to vacate the property by your landlord at any time. Rent can be increased by the landlord at any time. If a tenant does not have a rental agreement, they cannot claim tax exemption through HRA. Rent agreements are admissible in court.
What are remedies available to the tenants if the landlord refused to receive the monthly rent?
You can pay your rent to the local court if you want to stay. If they try to evict for not paying rent, you can challenge the action. When you go to court, the judge will trust you because you have the money.
