Original Registered and witnesses not traceable
12-Sep-2023 (In Property Law)
My mother written a will in my favour and the same was registered as well. Now, the original will is not traceable as also the witnesses. How can I get a duplicate Copy and whether it would be possible to include new witnesses. Since the property is inherited one by my mother, whether the same needs to be probated ?
You should first of all try to trace the original copy of the will as a registered will need not be probated and you can directly become a beneficiary. However, if you cannot get hold of it then you can approach the SDM office as they have a copy of the registered will. This might help you in the court of law but without the presence of witnesses, your case would be weak.
