Office in the name of father, how to distribute after his death

12-Sep-2023 (In Property Law)
A few years ago my father purchased an office. He got it registered in my brothers name. But the real owner of the property is my father. Please suggest a way that in case of of the demise of him rest of the family members can also use it and if it is sold the amount should be distributed amongst all the rightful members

Real owner of the property cannot be your father, as the property has got registered in your brother's name.

Even if you show that your father had paid consideration while purchasing the property, it will not create any right of other heirs because your father was free to give his moveable/immoveable property to anyone according to his wish.

You or any other heirs can assert having any right on the property only if you have any written contract executed between your father and your brother that the property is subject to rights of other heirs of your father.
