Occupation of my land by neighbours

Sir, Good afternoon, I constructed a house by 12' x 65' (out of 15' x 65') and keep 2' for passage for emergency during 2004. Recently one advocate constructed a house besides my house and occupied this passage of 2'(two feet) and says, according to Indian Municipal Rules, minimum three (3') feet are required. Hence you may lease this site. What can I do Sir, we are facing a lot of inconvenience. Kindly suggest me at once Sir.

If the construction is in violation of the plans then you may move to local civil court under which the property falls for obtaining a stay order against the illegal construction. 

The part of the building which has already come into existence as on the date of filing of the petition can be ordered to be demolished by court. 

Alongwith, file a RTI to the municipal corporation to obtain a copy of the sanctioned plan.
