Ninex developer builder goes in NCLT

I have book one flat from ninex developer of Rs 1.2 cr..and taken home loan of Rs 99 lac...I have paid 9 emi after that I am not able to pay EMI due to job loss. now I would like to cancel my flat and refund but now builder property goes into NCLT. Now bank said we registered as case section 138 against me..what can I do kindly suggest

- A case can be filed with RERA with facts and with inability of grounds of financial condition at present.
- Builder as per agreement only can forfeit earnst money that too depending upon agreement.
