Need to know the Rights of EWS Category Flats
20-Apr-2025 (In Property Law)
Main RWA of a residential complex in Gurgaon is not providing Basic services to EWS Flats like Housekeeping. However, they are providing Water & Electricity, but it is not regular. Residents are facing lot of challenges for basic needs. They are neither attending our complaints for electricity, plumbing nor they are charging us maintenance despite reminders. They are completely ignoring us.
Kindly suggest, whom to complain and what action to be taken in this regard.

Legal Advice – Action Against RWA in Gurgaon for Non-Providing Services to EWS Flats:
File Complaint with District Registrar (H-RERA/Urban Local Body):
Municipal Corporation Gurugram (MCG):
File an online or written complaint with MCG grievance cell regarding denial of water, sanitation, electricity services to EWS flats.
State Human Rights Commission or District Legal Services Authority (DLSA):
Since this concerns denial of basic human amenities, you may lodge a representation with Haryana State Human Rights Commission or DLSA, Gurugram.
RTI Application:
You may also file an RTI with the RWA or licensing authority to seek records of maintenance plans and fund usage for EWS services.
Legal Notice & Consumer Complaint:
If the issue persists, serve a legal notice to the RWA and file a complaint under the Consumer Protection Act, 2019 before the District Consumer Commission for deficiency in service.
