Need advise on flat related issue

I am staying in a flat. I have open balcony and above my balcony, there is a window of next floor flat. This next floor flat owner has build window chajja such a way that chajja (rain) water will come into my balcony, which is causing problem to my balcony.
As far a I know, it is illegal to build/construct anything outside flat area. And if some has to do that then it need permission from society, which he does not have it.
I raised this issue in society meeting several times but committee somehow avoiding to resolve this issue. I would like to know what legal actions I can take to solve this issue ?
As per your question :
1. You send a legal notice through advocate subject to illegally constructed chajja without any permission of society & it creates the big problems of rain in your house which harassed mentally , physically & economically .
2. Send another notice through advocate to the socitey main head for not responsing & nit initiative action taken against him .
