Need advice regarding acquiring property in Mumbai, India

28-Apr-2025 (In Property Law)
Hello, I am a US citizen, and my aunt is from India. My aunt back home in India wants to transfer her house to me after her death. She has made her will and also put me down as a nominee for her house. I have a couple of questions: Do I also need a POA, besides the will? I don't intend to sell the house; it will just be a transfer from her name to mine. What do I do here in the US, and what does she do in India? Thanks Theresa

Besides a Will you do not need any other document. It is only after the demise of your aunt that you will be able to get the house transferred in your name. Feel free to contact me for seeking any legal advice as regards the same.

On the basis of the will and the nomination made by your aunt, the said property will be transferred in your name in the society records and in the records of the local bodies. As regards to your question pertaining to execution of an POA, more information is needed on that behalf as to whether you will be carrying out any work in respect of that property on your aunt’s behalf!
