My rights in fathers property I am a married Christian woman

08-Feb-2023 (In Property Law)

I’m a married Christian woman. My dad died in 2004 intestate. My mother sold the house my dad had purchased and invested the proceeds in mutual funds/ other investments. The returns from investments were her sole income. In 2013 my brother started to manage these investments on her behalf. But he verbally manipulated her to transfer all the cash to his personal account on the pretext of reinvesting them for her. But he cheated & took all the money for himself. Do I have a right to the proceeds from the sale of my dads house? can i recover my share? Can I file a criminal case against my brother

According to the Indian Succession Act, 1925, every children has equal share in the property of the deceased property and every children of the deceased father has also gets equal share from the proceeds from the sale of the property. Therefore you have the right on the proceeds from the sale of the house of your father.
