My neighbour is disposing his house waste water by digging road

My neighbour is leaving his house waste water by digging road n which we travel in to a pit in front of my house and objecting to close that hole (Gundi) and in rainy season that put will get fill and water flows through my house area.please help me to resolve this problem to close that pit hole and road problem.
1. Write to local municipal authorities to remove the nuisance. If they do not get the problem resolved then approach local court to file a petition u/s 133 of CrPC to remove the nuisance which cause physical discomfort.
