My Brothers Are Not Allowing Me To Enter My House how to proceed

03-Sep-2023 (In Property Law)
I am a retired employee and Hindu by birth. My father had some property which is undistributed in the state of WB. Currently I stay along with my son. I supported my 2 brothers and 2 sisters in the best possible way with my limited source of money staying away from home. one of the land housed all my brothers and sisters . Rest all were agricultural. Slowly in one of the barren land I paid for the civil foundation for a 3 storeyed building in cash to my younger brother as he stayed there and run the shop. Slowly he built a 2 room house in it. After my son's marriage in 2010 I had invested around 2 lakhs cash to my brother and built a 2 room housing in the 1st floor of the same house. Gradually there were some hitches and now my younger brother who stays in the house is not allowing me. I don't have any proof of the money I spent. Though we have got the properties transferred in our brothers and sis name. Now what shall I do as local bodies and panchayat is not able to solve the case.

: Firstly you can serve your brothers with a legal notice through an advocate requiring them to give you right of possession. If they don’t recognise your right of possession even after service of legal notice then all you can do is to file a civil suit in appropriate civil Court for Recovery of Possession. Although it is difficult to prove your right to the property without having any evidence for proving your share in the property but a good advocate will surely figure out some way after going into details of your case.
