Mother torturing daughter what action can she take against her mother
25-Mar-2023 (In Property Law)
a person(father) dies without a will leaving behind his widowed wife and daughter with a dwelling house. widowed wife has a psycho problem with her daughter and always wants her daughter to suffer as it gives the widowed wife pleasure... now the daughter fears that in absence of her father, her mother may sell her portion of property or to bring her friends who are characterless and have physical relation with her to home, making her daughters life miserable. suggest some precautionary steps to the daughter. Note-her father is a cancer patient and dying but he does not want to make a will
2. So the mother without the consent of daughter can not sell her half share.
3.However to stop any untoward incident the daughter can file a suit for partition to get separate possession of her share and injunction so the dwelling house may not be sold to a stranger.
You have to file a partition suit before the Civil Court. Becausr after the demise of your father you and your mother is the legal heirs of your father. And also you have to prqy before the civil court for injunction until the final disposal of the suit. For further consultation contact me directly.
