Yes it is legal till the time your society does not raise any objections Just as a precautionary measure do not store stuff in the balcony which may prove to be hazardous to the life amid other residents of the society

You need to approve the changes from your concerned Municipal Council along with approved building plan for renovation/making changes. If you do it without any approval you will be in violation of sec 189-A of The Maharashtra Municipal Councils, Nagar Panchayats and Industrial Township Act,1965. If you violate the said section you will be liable to pay every year a penalty, which shall be equal to twice the property tax leviable on such building, so long as it remains as unlawful construction, without prejudice to any proceedings which may be instituted against you in respect of such unlawful construction. You cannot directly remove the wall partition if it is there in the previous approved building plan. Get a plan for renovation from an engineer and get it approved by the concerned municipal council or town planning office.
