Maharashtra Housing Society By-laws for Maintenance Charge per Flat.

Can any Hsg.Society charge two different rates/sq.ft in the same building of the same Society without additional benefit. Say Rs.2.25p /sq.ft for 2 BHK and Rs.2.00p/sq.ft for 3 BHK, with no difference of service being provided to all these Flats. Isn't this an inequality treatment ? What does the Law says ?.
Under the area wise maintenance charges menthod, the total costs incurred by the society are charged according to the area in terms of per square feet owned by each member. The common areas are divided equally using a fixed rates while flats are calculated depending on the size of apartment. But it should be same for all the flat holders in your case either Rs.2.25p or Rs.2.00 for all the flat owners. Same amount
