Liability of unpaid charges when purchase is through court DRT

07-Mar-2023 (In Property Law)

I had purchased a property thru DRT about 4 years ago. This is the issue of prev maintenance charges of the society. I thought I have to pay w e f the day of registry. The society wants me to pay from date of successful auction (the gap is 2 yrs.) with accrued interests. What am I liable to pay please? Kind regards

Yes you are liable to pay the society dues from the date you acquired rights over the property i.e. the date of successful auction. You may also be asked to pay interest on the due amount but they should have in that case brought it to your information earlier that you are supposed to pay maintenance. If they never gave you notice to pay the maintenance then you can say that it was their duty to inform you. Had you known then you would have already paid and so here the first duty was of the society.
