Legal requirements to sell property
12-Jul-2023 (In Property Law)
I had bought a property on loan in 2005 with my father as a co-applicant but I have been paying all EMI's myself . My father expired in 2012 My name is first on the agreement and share certificate in my name. I want to know whether I have to take a NOC from other legal heirs i.e. my mother, and younger brother and sister for selling the flat?
yes in this case as according to the law the property will be transferred to his legal heirs so you neeed to take the No objection certificate from his legal heirs including your mother, and younger brother and sister for selling the flat.
