Legal procedure to transfer property held by mother who died intestate

10-Jul-2023 (In Property Law)
My mother passed away intestate(without a will)-so my father, brother and me will get equal share in her property as per Hindu law.My brother does not want a share in the property. What is the legal process of transferring my mother's property to my father's and my name. What documents does my brother need to sign to give up his share to us?My brother lives in another state so will he have to come to Pune to complete the legal formalities of transfer of property or can we get the the documents made from the city in which he lives?

Your brother would need to make a release deed in favour of you and your father wherein he will relinquish his right in the property. This document will need to be registered at the sub- registrar's office where the property is located and stamp duty would also have to be paid on this document.
