Since the flat is in your late father’s name, it is inherited property under the Indian Succession Act, 1925. All six children, including you, are legal heirs. To sell the flat, you need either a release deed from your siblings, where they give up their shares in your favor, or their consent for a joint sale. If there’s no agreement, you can approach the court for a succession certificate or file for partition. Once ownership is clear, you can execute a sale deed. The simplest approach is to obtain a release deed if your siblings agree to transfer their shares.

In order to sell the said flat you can seek an NOC from your siblings in respect of the said flat. You can also go for a release deed in your favour. Feel free to contact me for seeking any legal assistance as regards the same.
