Legal correction in death details in sale agreement deed.
18-Dec-2023 (In Property Law)
I have recently committed to purchase a plot in Chennai worth close to 30 Lakhs (3500 SQ FT), I have registered a sale agreement with PoA/Vendor by paying 50% of the agreed sale amount and I'm planning to get the sale completed in next weeks time. The property was initially registered in 1968 by Mr. Anbuselvan and he passed away in the year 2013. Then the legal heirs (his 2 children and wife) gave the power to Mr. Raja in Sep 2017 and then I have gone for a sale agreement with PoA in Oct 2017. Recently, I have noticed that the death details have been incorrectly mentioned in both the documents (PoA and Sale agreement), I do not know whether it was intentionally done or not. I have contacted the vendor(s) and they gave me the different death certificate which I verified with the concerned issuing department and got the true copy as well. I then did a background check of the original owner (family) and all other documents, it all proved proper. can this be legally corrected and how?
You can make rectification of date of death in the sale agreement on filing rectification deed in the concern Registrar office producing proof of death certificate and stating the ignorance of facts.
More over date of death of the vendor is immaterial.
