02-Mar-2023 (In Property Law)
We have property in madipakkam which chennai corporation. Our father wrote a will that The Land was divided in to 3 parts and gave to 3 of his children. That will is registered one. I have sold the my part without probate as it's registered will. Now, can my brothers file a case against me that why did i sell my portion without taking probate? Because, now they applied probate for their portion.

Selling a property, within the Original Jurisdiction of the High Court of Madras, without probating the will would not give a proper title to the buyer.
Assuming that the property that was allotted to you in the will was specified, your brothers cannot file any proceedings against you. However, the buyer of your property may file a case against you asking you to deliver a proper title to the property that you have sold.
