Legal Concerns Regarding Delayed Registration in 7/12

We booked a 1700 sqft plot by Srushti Realmart in January 2018, shifted to another project in March 2023 due to registration delays. The sale was registered under Mudat Kharedi Khat (Conditional Sale Deed), without clear disclosure of its legal implications.
On January 28, 2024, the developer requested a Power of Attorney, promising to proceed with Samaik Kharedi Khat (Consolidated Sale Deed) and 7/12 extract mutation. However, despite repeated follow-ups, the documents remain stuck.
Non-disclosure of Legal Implications – If the developer did not clearly inform you about the impact of Mudat Kharedi Khat (Conditional Sale Deed), it may be considered a case of misrepresentation or unfair trade practice under consumer protection laws.
Power of Attorney (POA) Issue – A POA should only be given for a specific and legitimate purpose. If the developer has not acted despite obtaining the POA, you may revoke it and take legal action for non-performance.
Failure to Register Samaik Kharedi Khat (Consolidated Sale Deed) – If the developer is delaying registration despite promises, you may:
Send a legal notice demanding completion of the registration.
Approach the Real Estate Regulatory Authority (RERA) if the project is registered.
File a consumer complaint for deficiency in service and seek compensation.
7/12 Extract Mutation Delay – If the developer is not initiating the transfer, you may file an application directly with the revenue authorities and seek legal remedies for delay.
