16-Feb-2023 (In Property Law)
1.Maternal grand father given a house site to my mother. After the death of my mother same land is recorded in the name of my father & his eight sibling(8).Without getting any notice from Revenue Department that my father is mutated his share to one of his son. I would like to know that can he do so legally. That land is not purchased by my father can his share not be distributed among all of his (8) siblings. 2.From the same land one son is earning by getting rent & Other two rooms are occupied by another son.Legally what will be the solution for other 6 person who are devoid of any benefit.
You have stated that the land was recorded in the name of your father and his eight siblings. The meaning of sibling is, of or relating to a brother or sister: This indicates that your father and his brothers and sisters got the land transferred on their names without allotting the entitled share of the children of your deceased mother.
However, if you are one of the legal heirs to the property intestate, you may file a partition suit seeking your share and separate possession along with a share in the rental income too.
