Land encroachment by neighbor can I use that property

I have an ancestral land under the taluka in Nanded district. My neighbor had illegally sold off a plot of size 20*40 ft of my land which borders the neighbors land and got it registered to the seller. My father had Filed suit for encroachment on the neighbor but were not able to prove it, we lost the case. Another appeal had been filed. My father had passed away and the defendant has also passed away. The lawyers from both sides have updated the suit with legal heirs on both side. In the same survey no., I have at the least 10 gunta land left (under my possession, free from any claim). My question is Can i sell, lease or rent this land. In doing so, will I be doing anything illegal? thanks for reading, and answering.
