Land dispute with relative

We had a land dispute with one of our relatives, hence he filed a case against us. But we have winesses and proof as well to prove that we are not guilty. Recently our lawyer asked us give the names of our witnesses to him so that he can put in front of the court. Later he told us that the relative with whom we had d dispute, could not give a single name of witness. Since then we had to be present in the court couple of times to sign some paper but our relative was not there even once. My question is why only we had to be present in court and how come dat relative of ours is not present

If the said relative is not present in the said case then you do not need to worry about the same as it is his fault. Also, if he keeps being absent in the future the court may grant you ex parte decision in your favour or may acquit you on benefit of doubt as the plaintiff was unable to formulate charges against you. Also, after the disposal of the case you can initiate proceedings against the said relative for malicious prosecution.

Sir you have not stated specifically about type of land disput. Most probably the case is in evidence stage now if opp. Party failed to appear before the hon'ble court then your case should be proceed and disposedup ex party.
