issue related used stamp paper in family property deal

Hello team, I hope you are doing well. My query is that there was a discussion between my father and my uncle on the farm land. We have written all the points and deal with a 500 stamp in 2022, but we did not notarize it and didn't affidavit it. so does that stamp can be notarize now.

If the agreement between your father and your uncle regarding the farmland was executed on a ₹500 stamp paper in 2022 but was not notarized or affirmed through an affidavit, it may still hold evidentiary value, especially if it bears the signatures of both parties and clearly mentions the terms. However, notarization is a process that must be done at the time of execution—you cannot notarize a document retrospectively after such a long gap. The notary public must witness the signing of the document, which cannot be done post-facto. That said, the stamped agreement can still be used as supporting evidence in any civil proceedings, subject to the court’s discretion. For stronger legal standing, you may consider executing a fresh agreement with mutual consent and getting it properly notarized or even registered this time. There is no mandatory requirement to get your family settlement notarized. still you can get it notarized whenever you want irrespective of the fact that both the parties are willing to do so. Notary in family settlement plays no or very less role to help you out in getting your settlement executed.
