Is there any discrepancy in purchasing a resale flat what to do

Dear Sir, Greetings!! I have looked for the Mhada resale flat to purchase which construction completion is more than 15 years. The Owner of mhada Resale Flat is 2nd Owner of that flat. He had purchased that flat 10 years back. According to 2nd Owner, He has Paid Stamp Duty and done flat Transfer through Mhada on his name. But not done registration because the 1st Owner left the country that time and not available till now. I have checked that Stamp duty paid documents are with 2nd owner and also mhada has given him transfer of the flat with mhada transfer document. Kindly suggest me if there is any discrepancy to purchase that resale flat. Kindly give me legal advice. Thanks

Society will not agree if the previous agreement is not registered.. so if the first owner can't come then he can atleast give his power of attorney to someone else to appear for registration on his behalf.. you should go to the registrar of assurances and ask if it can be directly transferred (chances of which are very rare)
