Is it legal to charge maintenance without forming a society

I have brought 2BHK flat in Thane with OC for my building but the project is incomplete, builder took 60,000 maintainable first. Then after one year he is asking for maintenance monthly separately for 1BHK,2BHK. I am filling property tax too separately. Is it legal by builder to ask maintenance and separate for both 1and 2 BHK without forming society.
No the builder can not demand such extra charges, you can send him a legal notice for the denial of the payment and then on you can file a complaint in the consumer forum for deficiency in services.
