is it legal to buyan apartment whose land doesn't have full conversion

I am planning to buy an apartment which is constructed on a land which doesn't have full conversion. the plot has 28 dags out of which approximately 12 are converted to vastu, 2 are ponds and rest of them are Shali lands. the property is located in Rajpur Sonarpur Municipality area of KOLKATA. is it legal to buy the property? please advise. one more important thing is the current owner didn't register the property mutation in their name. SBI didn't approve loans but HDFC agreed to provide loan.
