Is it advisable to buy property which isnt registered on sellers name

We found an old house that could be replaced by our dream home. However it is not registered on Seller's name. It was gifted through will by his father and mother. Both are now expired and the property as per papers (dated 1961) is still in the name of NRI’s mother. Is it okay to venture in to this property? If yes, what legal precautions need to be taken?

You need to ask the seller to apply for probate and when he gets the ownership rights and possession to his property he can then sell the property to you.
