As per the provisions of the Limitation Act, 1963, the time limit prescribed to institute a suit for possession for enforcing a right relating to an immovable property is 12 years. Therefore your mother cannot make any claim in relation to your grandfather’s property since it is barred by limitation but she can claim her share in the property of her mother (your grandmother) by filing a civil suit in appropriate Civil Court. However, it is important to note that the quantum of share of female heir is half of that of the male heirs since this is the prevalent practice.
