Illegal possession on first floor terrace

My name is Joseph. I recently bought the ground floor of a semi-independent house; the first floor is owned by a different person, Arun. total square footage on the property is 2400 soft. I own 1000 square feet sharerof UDS and the first floor owner possess 1400 square feet. The problem now is that the first-floor owner, Arun, wants to sell his brother 400 square feet from his UDS to construct a room on the first floor open terrace. Is he allowed to build a room Now , how this would affect me ?
