Illegal possession of joint property by paternal uncle what to do

My father and his elder brother purchased a house ( individual house one for my father and other for his brother ) in 2000 in pune and his elder brother without his knowledge registered in his name but the amount was paid by both . And my father stayed in that house for almost 10 years then moved to chennai And 2007 he expired after which the elder brother family claims its there property and not ready to give the share to my father and even not allowing for rental purpose. Please suggest what we could on this
You will have to provide the proof of the transaction by which the amount for the said property was paid. Also, the said transaction is governed by Benami transaction, and the said transaction is valid. Also, if you are able to to proof the said transaction then you are also eligible for claiming your share in the said property.
