Illegal dimensions for site auction by bank

Full land is equally divided by me and my friend. My friend is under huge loss and unable to repay debt. So the bank where she had mortagaged her land is sent a debt recovery notice with auction proceeding for FULL land instead of only her portion. What course of action to take so that I get to keep my land?

You must approach DRT and immediately get a stay from it. The bank has no right what so ever on your property. As a immediate relief you can also approch High Court as get quash the notice as the charge is not created on your property.

1. You need to immediately repond to the notice. If the banker already initiated the process of auction then you need to approach court to file injunction suit. 2. Do you have document proof of that you and your friend divided the property?. 3. Approach a local lawyer immediately.
