I have booked a commercial flat and builder has stopped work

i have booked a commercial property in kandivali charkop,and as of now i am on allotment letter, since 2 yrs builder has stopped the work and not doing aggrement and also bank has taken symbolic possesion of the property. now builder is ready to do agreement but without the noc of the bank , is it adviseable to do agreement or it is of no use without bank noc./

No, it is not advisable to enter into an agreement without the NOC of the Bank. Since the Bank may raise an objection afterwards and in such a case it has the power to detain the Title documents of the property and it may also recover the possession of such land by way of Recovery of Land Arrears
