How to transfer the ownership of inherited property

On the expiry of our parents we three brothers have got the house mutated in our names. Is it necessary to get the house transferred to our names.? What is the best legal option if there is no dispute or disagreement? Please advise. Thanks. We are Hindus

Please file suit for partition and get the property legally divided as per agreement in brothers. On decree, the title needs to be registered with revenue department.

A family settlement deed needs to be executed first.

You should go for a partition deed. In case a partition is by mutual consent (no dispute or disagreement), the deed is to be executed by the co-owners. The partition deed is required to be registered at the office of the sub-registrar of the place where the property is situated as in case of any other registration. The stamp duty payable in such a case is Rs 1,000 for each share of the property.

That a good sign that there is no dispute between the brothers. Just enter into family settlement agreement and file a partition suit and divide the property so that even if any one wishes to sell its share then there will be no problem. Rest your name in the mutation document is enough to prove that you all are the owners of the property

Once you have got the property mutated in your name and the same is registered by the Sub-registrar, you have become the rightful owner of the Property. Now, you need to get the names updated in the revenue records maintained by civic bodies like Municipalities, Panchayats or Municipal Corporations.
